Copyright & Takedown Policy
Version 1.0.0 · Effective {{EFFECTIVE_DATE}}
We respect copyright and expect our users to do the same. This policy explains our song rules, how to report content that infringes your rights or is otherwise illegal, how we respond, and what happens to users who infringe repeatedly. It is designed to meet the US Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512), the EU Digital Services Act (DSA, Articles 16, 17 and 20), Turkish Law No. 5651 and Law No. 5846, and similar notice-and-takedown rules.
1. Our song library
We only publish songs that we believe are in the public domain worldwide: traditional or anonymous melodies, and works whose composer and lyricist died more than 100 years ago. We enter the melodies ourselves from the original tune, not from modern arrangements, editions or recordings. Sounds and fonts come from CC0, unrestricted or open-licence sources. If you believe something in our library is still protected, tell us and we will check and, if needed, remove it promptly.
2. User content
Users may record and share their own performances. Users are fully responsible for what they record and share and must not share protected works without permission (see the Terms of Use, section 5). We do not pre-screen content, but we act on notices.
3. How to send a notice
Send your notice to info@playwithkeyboard.com (subject "Copyright notice" or "Illegal content notice"), use the "Report" button on the content, or write to {{COMPANY_NAME}}, {{ADDRESS}}. Designated DMCA agent: {{DMCA_AGENT}}.
Please include:
- your name and contact details (email), and, if you act for someone else, on whose behalf;
- identification of the copyrighted work (or other right) you claim is infringed;
- the exact URL(s) of the content on our Service (share link, duel page, profile);
- an explanation of why the content is infringing or illegal;
- a statement that you have a good-faith belief that the use is not authorised by the rightsholder, its agent or the law;
- a statement that the information in the notice is accurate and — under penalty of perjury for DMCA notices — that you are the rightsholder or authorised to act for them;
- your physical or electronic signature.
Notices that are clearly incomplete may delay our response; we will ask for what is missing. Knowingly false notices can make you liable for damages.
4. What we do
- We confirm receipt of your notice (where you gave an email address).
- We review it promptly and diligently, usually within 72 hours, and remove or disable access to the content if the notice is valid or the content is clearly illegal.
- We inform the user who posted it of the decision, the reason, the notice (contact details may be redacted) and the right to respond (a "statement of reasons").
- We tell the notifier what we decided.
- We keep records of notices and decisions for 3 years.
Court or authority orders (for example access-blocking or removal decisions under Turkish Law No. 5651) are carried out within the legal deadline.
5. Counter-notice and appeal
If your content was removed and you believe this was a mistake or that you have the right to use it, send a counter-notice to info@playwithkeyboard.com with:
- your name, username, email and address;
- the removed content and where it was;
- a statement, under penalty of perjury (DMCA), that you have a good-faith belief the content was removed by mistake or misidentification;
- for DMCA counter-notices: your consent to the jurisdiction of the federal court for your district (or, outside the USA, any judicial district in which we may be found) and that you will accept service from the person who sent the notice;
- your signature.
For DMCA counter-notices, we forward them to the notifier and may restore the content after 10–14 business days unless the notifier informs us that it has filed a court action. Under the DSA you can also use our internal complaint process (reply to our decision email), certified out-of-court dispute settlement bodies, or the courts.
6. Repeat infringers
We count a strike for each piece of content removed because of a valid copyright notice that was not successfully countered.
- 1st strike: warning and removal.
- 2nd strike within 12 months: sharing and recording features are suspended for 30 days.
- 3rd strike within 12 months: the account is permanently terminated, and the user may not create a new one.
In serious cases (for example deliberate mass infringement) we may terminate immediately. Strikes expire after 12 months.
7. Misuse of the notice system
We may stop processing notices or complaints from people who frequently submit manifestly unfounded ones, after a warning.
